What is New York Paid Family Leave?

New York Paid Family Leave (PFL) gives most employees in the state paid, job-protected time off to bond with a new child, care for a family member with a serious health condition, or handle certain needs when a family member is deployed on active military service. It is one of the most far-reaching state paid-leave programs in the country.

PFL is usually funded through a state-mandated insurance policy paid for by employee payroll deductions, so the direct cost to the employer is small. What PFL demands from employers instead is administration: enrolling coverage, informing employees, coordinating claims with the insurer, and holding the job open.

PFL does not stand alone. New York also has short-term disability benefits (DBL) that cover an employee’s own health condition, including the medical recovery portion of childbirth, and federal FMLA runs on top of both. The three programs cover different situations and often connect within a single leave.

What does NY PFL provide?

PFL provides several weeks of paid, job-protected leave at a percentage of the employee’s average weekly wage, capped at a share of the statewide average weekly wage.
