California Minimum Wage Increases to $16.00 Per Hour Effective January 1, 2024
By Joel Riley
California's statewide minimum wage increased to $16.00 per hour effective January 1, 2024. All employers regardless of size must comply with the new rate.
What Changed
California's statewide minimum wage increased from $15.50 to $16.00 per hour effective January 1, 2024. This applies to all employers regardless of size, eliminating the previous distinction between large and small employers. The increase was set by the automatic adjustment provisions under Labor Code Section 1182.12, which ties annual increases to the Consumer Price Index.
Note: This is the general statewide minimum wage. Separate, higher minimum wages apply to fast food workers ($20.00/hour under AB 1228, effective April 1, 2024) and healthcare workers (under SB 525, with phased increases beginning later in 2024). Many California cities and counties also maintain local minimum wages above the state floor.
Who Is Affected
All California employers, regardless of size. The $16.00/hour rate applies to all non-exempt employees, including full-time, part-time, and temporary workers. Employers with operations in cities or counties with higher local minimum wages must pay the higher applicable rate.
Where It Applies
California statewide. Employers should also check local minimum wage ordinances in jurisdictions such as San Francisco, Los Angeles, San Jose, and others, which may impose higher rates.
When It Takes Effect
Effective January 1, 2024. Employers must have adjusted payroll prior to the first pay period of 2024.
Why It Matters
California's minimum wage is among the highest in the nation, and non-compliance carries steep consequences. Employers who fail to pay the correct minimum wage may face penalties of $100 per employee for the initial violation and $250 per employee for subsequent violations, plus payment of back wages. The updated rate also affects the salary threshold for exempt employees in California, which is calculated at twice the minimum wage for a full-time schedule ($66,560 annually at $16.00/hour). Additionally, updated minimum wage posters are required at all work locations.
The Humareso Take
California's $16.00 floor is just the starting point for 2024. With the fast food and healthcare minimums layering on top, employers operating in California are managing a more complex wage landscape than ever before. If you also have employees in cities with their own local minimums, the compliance burden multiplies quickly. We strongly recommend a payroll audit early in the year to make sure every employee is at the correct rate for their work location and industry.
Recommended Action Steps
Update payroll systems to reflect the $16.00/hour minimum wage effective January 1, 2024.
Review exempt employee salary thresholds, which increase to $66,560 annually based on the new minimum wage.
Check local minimum wage ordinances for any cities or counties where your employees work, as many exceed the state minimum.
Post updated California minimum wage posters in a conspicuous location at all worksites.
Audit compensation for fast food and healthcare workers if applicable, as separate higher minimums apply under AB 1228 and SB 525.
